Sainsbury Parking Ticket
Got a £30 fine last week. I had a parking ticket but it wasn't properly displayed, had slipped down the dashboard so wasn't fully visible.

Emailed Sainsburys with both parking ticket & fine attached, as well as proof I had been shopping in there at the time. Got back a standard reply saying I had to contact Horizon parking directly. I'd imagine if I went in store i'd get a similar reply.

Any advice on what to do next? I'm guessing we're past the days when you can just ignore them, have read stuff online that once you get in contact with them then they have your details and can go through the courts.

Just been into the store. Took about two minutes - woman on customer service said she'd get it cancelled.

"Yes it was, she said IF it was on display, the attendant would of seen it...."

I suspect scraper was asking if this was a direct quote for the reason that you have made a common mistake in the use of English.

"The attendant would of seen it..." should say the attendant would have seen it... or would've seen it.

Would of seen it makes no sense. It means - would from/for seen it.

Second thoughts - it was so long ago that this happened to me that the warden wouldn't have had a camera phone, and would have gone to court armed only with his word - different now, I suppose

Re: Sainsbury Parking Ticket
I had the same problem with Leeds City Council - they let me off with a ticking off about displaying the ticket properly.

I suspect that if I had insisted that it had been properly displayed, even though it wasn't, I would have won if it had come to court - possession of the ticket is key.

Ricky,
Ignore it. 100%

The law change in 2013 simply makes the owner of the vehicle 'responsible', it doesn't change the fact this company must effectively sue you for breach of contract and win.

The business model is fear. Make the ticket look similar to a penalty charge notice, write threatening letters, threaten bailiffs.

If you ignore the letter they must risk that model by taking you to court and potentially losing - destroying the fear model in the process.

There is no evidence of them successfully taking cases to court and winning. Them initiating small claims court proceedings is a further scare tactic that if you file a defence, they withdraw.

Also note that an agent cannot sue on behalf of a loser, so once you receive a letter from a 2nd company, you know they've sold the debt and you're completely clear.

I've had around 10 in the last 3 years and other than lots of letters threatening me, no more has come.

Absolutely spot on mate. Never contact the parking company and the do nothing.

Yes mate, sorry I forgot to say they were all going in the bin.

I got one a few years ago, I went through all the hassle of the appeal and then appealled the appeal to POPLA (who rejected it and tole me I had to pay). Money Saving Expert told me I had come to the end.

What happened? Nothing. They didn't even write to me saying I had lost the appeal and pay up! Tossers.

If the fine is labelled PENALTY Fine, it needs to be paid, or you I'll face prosecution. If it says PARKING Fine, you can bin it, along with threats of being taken to court that will follow.

I still don't understand why you needed a ticket to park at a supermarket. Never seen this ever, how bizarre.

Re: Sainsbury Parking Ticket
Spandex,
the ticket is not enforceable, the only legal parking tickets are issued by the Police or a traffic warden.
all these parking companies Parking Eye,Horizon
etc, will just keep sending you threatening letters for payment ,ignore them.

Re: Sainsbury Parking Ticket
Fuck them, I got one is a Morrisons for over staying. Got increasing desperate 'we will eat your children' letters, red everywhere.

However if you look closely, all of these letter are pre printed, not personal in any way, even the signature is printed. I've had about seven in the last six months about it. Now they are offering me to pay half the escalated amount..

If they actually start court proceedings I will just pay it (£80 now) and they will have paid £400 to start said court proceedings, which they won't get back and then will have no case. But they won't, why pay £400 for a small claim when the amount is much lower than that?

Their business plan is a certain percentage will just pay up and the rest won't. it's easy money for just sending letters.

Re: Sainsbury Parking Ticket
what you have is an invoice for payment not a parking ticket.

ive had loads of these, london hotel car parks, leisure centre, private flats car park, supermarkets, luton airport and others.

as ted said, if its old bill or council pay up! no way out!

in your case, Go back to Sainsburys, ask for manager, produce all your evidence, ask him to contact direct horizon and get it removed, easy! dont take anything else for an answer!

in my case, never paid one of them! they chased me, with loads of reminder letters, threats from bailiffs. after 6 months they go quite.

or i talk to the manager and have them cancel it

good luck

Re: Sainsbury Parking Ticket
Yes it was, she said IF it was on display, the attendant would of seen it. I photoed it straight away, (Close up) showing the ticket in the bottom left corner, the photos the attendant had taken were of the side/rear and one straight on, but about 6 feet away from the car, and with not a clear view into the car. I could see a white line in the bottom left corner of the photo, and pointed this out. Still no joy. It came down to the attendants word against mine, and I was gutted because unlike some likely lads I had bought a ticket, and it was clearly on display!! If im honest I was going to take it further, not pay it, and go to court on it. But it would of involved time off, and who knows what a dodgy judge would say/do!!

Re: Sainsbury Parking Ticket
Alan's last message is correct. The old advice to ignore them used to work but is risky now.

As I said earlier the EASIEST solution that has worked for my family members is to go in the store and explain it to the manager.

Each time I did this for them the store contacted the parking company and had the invoice cancelled.

On one occasion the manager phoned the company while I was there and said it was a customer who was taken ill and overstayed. Not actually true but it worked.

On another occasion the person who made the call said that the car belonged to a member of staff. Not true either but it worked too.

"The parking attendant would not of been able not to see the ticket if it was properly displayed"

Is that a direct quote? 🤔

Re: Sainsbury Parking Ticket
Don't pay it. Send one letter to the parking firm explaining you're not paying it and the reason why. End it along the lines of "I assume this will suffice, and will hear no further".

Likelihood is they won't respond, and you're in the clear. In any case, they are not going to take you to court for that sort of money. They'll just write it off. Private firms rarely take it further, they chance their arm for naive people.

Only pay parking fines if it's issued by the government.
